Our legal powers
The NSW Small Business Commissioner is an independent statutory officer. The role of the Commissioner is laid out in the Small Business Commissioner Act 2013.
Under the legislation, the Commissioner can:
- Investigate allegations of unfair treatment or unfair contracts
- Compel local Councils, NSW Government bodies and other businesses to provide information or answer questions when a complaint is made
- Require parties to attend mediation before starting more expensive and time consuming court battles, whether those parties are businesses (small and large) or government departments
- Report directly to Parliament where there is an issue of major importance to small businesses.
