The NSW Small Business Commissioner is an independent statutory officer. The role of the Commissioner in helping small businesses in the state is laid out in the Small Business Commissioner Act 2013.
The Commissioner is a strong voice for small business in NSW. The Commissioner speaks to government about small business issues and runs a number of programs to assist small businesses throughout the state.
Under the legislation, the Commissioner can:
- investigate allegations of unfair treatment or unfair contracts
- require local councils, state government bodies and other businesses to provide information or answer questions when a complaint is made
- insist parties attend mediation before starting more expensive and time-consuming court battles, whether those parties are businesses (small and large) or government departments
- report directly to Parliament where there is an issue of real importance to small businesses.
