Retail Tenant's Guide

The Tenant's Guide helps tenants understand the key aspects of leasing a retail shop. The landlord must give the Guide to a prospective tenant as soon as they start negotiating a lease.

A retail lease is covered by different law from a residential lease. In NSW the Retail Leases Act 1994 (the Act) sets out legal arrangements between landlords and tenants for shops selling and supplying goods and services, where the shop is less than 1,000 square metres and is used for a retail business.

The Act covers what you must do when:

  • starting a lease
  • changing the rent;
  • transferring a lease; and
  • you are in dispute with your landlord.
